1. Acceptance of these terms

These Terms of Service (“Terms”) are an agreement between you and Purva Heritage, operating from Ballygunge Place, Kolkata 700019, West Bengal, India. They apply to your use of this website and to every order you place with us. If you do not agree to these Terms, please do not use the site or place an order. These Terms should be read together with our Privacy Policy.

2. Eligibility

You may use the site and place orders only if you are at least 18 years old and able to enter into a legally binding contract. By ordering, you confirm that the information you give us is accurate and that the payment method you use is your own or that you are authorised to use it.

3. Your account

You may need an account to place or track orders. You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly if you believe your account has been used without your permission. We may suspend or close an account that is used in breach of these Terms or the law.

4. Products & handmade variation

Our products are made by hand by artisans using natural materials. As a result, each piece is unique. Variations in colour, grain, weight, finish, size and small irregularities are inherent to the craft and are not defects. Product photographs are indicative; the item you receive may differ slightly in appearance. Screen settings can also affect how colours appear.

Stock is limited and often made in small batches. We cannot guarantee that a specific piece shown will be the exact piece dispatched unless it is sold as a one-of-a-kind item.

5. Pricing & descriptions

Prices are shown in Indian Rupees and, unless stated otherwise, are inclusive of applicable taxes but exclusive of shipping, which is shown at checkout. We take care to describe and price products accurately, but errors can occur. If we find an error in the price or description of an item you have ordered, we will contact you to confirm whether you wish to continue at the correct price or cancel, and we may cancel the order and refund any amount paid.

We may change prices, product ranges and offers at any time. Changes do not affect orders we have already accepted.

6. Orders & acceptance

When you place an order you make an offer to buy. We will send an acknowledgement of receipt, which is not acceptance. A contract is formed only when we send an order confirmation or dispatch the goods. We may decline or cancel an order — for example if an item is out of stock, if there is a pricing or description error, if we suspect fraud, or if we cannot deliver to your address — and we will refund any payment for a declined or cancelled order.

7. Payment

Payment is taken through our third-party payment partners at the time of order unless another arrangement is confirmed in writing. You authorise us and our partners to charge the payment method you provide for the order total, including shipping and any taxes. If a payment fails or is reversed, we may cancel the order or suspend delivery until payment is completed.

8. Shipping & delivery

We ship through third-party courier and postal partners. Delivery timelines shown on the site are estimates and are not guaranteed. Risk in the goods passes to you on delivery to the address you provide. Please give a complete, correct address and a reachable phone number; re-delivery or return caused by an incorrect address or a failed collection may incur additional charges.

For fragile crafts such as terracotta and sholapith, we pack carefully. Please inspect your parcel on arrival and tell us within 48 hours if an item has arrived damaged, with photographs of the item and packaging.

9. Returns, exchanges & cancellations

You may cancel an order before it is dispatched by contacting us. Once dispatched, our returns process applies. Unless required otherwise by law, you may request a return or exchange within 7 days of delivery, provided the item is unused, in its original condition and packaging, and accompanied by proof of purchase.

• Made-to-order, custom and personalised pieces cannot be returned unless they are faulty or not as described.
• Return shipping is arranged by you unless the item is faulty, damaged in transit or incorrect, in which case we cover reasonable return costs.
• Approved refunds are made to the original payment method within a reasonable period after we receive and inspect the item.

Nothing in this section affects your statutory rights as a consumer in respect of faulty goods.

10. Custom & bulk orders

Custom, bulk and wholesale orders are governed by a separate written quotation or order form, which forms part of these Terms for that order. Such orders usually require an advance deposit, have longer lead times, and are non-cancellable once production has begun. Minor handmade variation across a batch is expected and is not a defect.

11. Intellectual property

All content on this website — text, photographs, graphics, logos, the “Purva Heritage” name and page design — is owned by Purva Heritage or its licensors and is protected by intellectual-property laws. You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, republish, sell or exploit any part of the site without our prior written permission.

12. Your content & conduct

If you submit reviews, images, comments or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with our business. You confirm the material is yours to share and is not unlawful, misleading, defamatory or infringing. You agree not to misuse the site, including by attempting to gain unauthorised access, introducing malicious code, scraping content at scale, or interfering with its operation. We may remove content and restrict access at our discretion.

13. Third-party links

The site may link to third-party websites and services that we do not control. We provide these links for convenience only and are not responsible for their content, policies or practices.

14. Disclaimers

The website and its content are provided “as is” and “as available”. To the extent permitted by law, we do not warrant that the site will be uninterrupted, error-free or secure, or that information on it is complete or current. Handmade variation described in section 4 is not a breach of any warranty.

15. Limitation of liability

To the fullest extent permitted by law, Purva Heritage is not liable for indirect, incidental, special or consequential losses, or for loss of profit, revenue, data or goodwill, arising from your use of the site or any product. Our total liability in connection with any order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence or for fraud.

16. Indemnification

You agree to indemnify and hold harmless Purva Heritage and its officers, employees and partners from claims, damages and reasonable expenses arising out of your breach of these Terms, your misuse of the site, or your infringement of any third-party right.

17. Governing law & disputes

These Terms are governed by the laws of India. Subject to any non-waivable consumer rights, the courts at Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the site. We encourage you to contact us first so we can try to resolve any issue informally.

18. Changes to these terms

We may update these Terms from time to time. The version in force is the one published on this page when you place an order. Where changes are significant we will give notice by a website notice or email. Continuing to use the site after changes take effect means you accept the updated Terms.
